聚焦互聯網金融、民營金融等前沿領域楊學聰 李治國本報訊 記者楊學聰 李治國報道:網信金融與上海黃浦區金融辦日前正式簽約,儲存將入駐上海黃浦的外灘金融創新試驗區。網信金融CEO盛佳表示,互聯網金融是當前的熱點領域,公司是互聯網金融領域的重點企業,而上海黃浦外灘金融創新試驗區正是以互聯網金融作為發展的著力點,因此,入駐這一園區就為企業的創新發展提供了巨大空間。落戶外灘金融創新試驗區的企業已非一家。上海黃浦區副區長吳成在接受記者採訪時表示,上海新一輪金融創新的著力點,將聚焦互聯網金融、民營金融等前沿領域。今年7月底建設外灘金融創新試驗區的消息發佈後,引起的反響遠超預期,據不完全統計,一個多月的時間里,目前僅上海黃浦區金融辦接觸的與互聯網金融和民營金融有關的機構就有40余家,按工作日計算的話達到日均2家以上,已經有近10家明確表達了設立公司參與外灘金融創新試驗區的意向,部分企業已經開始進入工商註冊流程。這些企業涉及金融控股、互聯網支付、P2P網絡信貸、雲銀行、在線金融產品銷售、財富管理、金融信息服務平台等許多類新蒲崗迷你倉,其中有許多新興的商業模式。吳成告訴記者,《黃浦區關於建設外灘金融創新試驗區的實施意見細則》已經正式公佈,其中包括允許符合條件的企業在名稱中使用“外灘”字樣等一些創新嘗試。吳成說,“外灘作為全球知名的地標區域,一般不被允許在企業名稱中使用,我們這樣做是為了表明全力支持金融創新的決心。”值得注意的是,該《意見細則》中的政策扶持不僅覆蓋企業,還充分考慮了投身其中的核心團隊和個人的作用,綜合來看,對金融企業的補貼和獎勵金額遠超一般行業。吳成表示,黃浦區此舉意在“放水養魚”,激勵創新。“黃浦的外灘區域曾經是遠東金融中心,如今,經歷多年發展,在金融創新方面始終走在我國金融創新的前沿。”上海黃浦區金融辦主任江錫洲表示,近年來,互聯網金融和民營金融發展勢頭迅猛,傳統金融機構也正不斷加快“互聯網化”步伐,因此黃浦區在推進外灘金融創新試驗區的同時,還與上海金融研究院共同設立中國互聯網金融研究中心和中國民營金融研究中心,通過實踐探索、理論研究,摸索出一些有前瞻性、規律性的問題,引領金融創新風向,助力上海國際金融中心建設。mini storage

誹謗信息被轉發達500次可判刑
信息來源於四川新聞網 / Cited from .newssc.org/楊仕成 製圖《最高人民法院、最高人民檢察院關於辦理利用信息網絡實施誹謗等刑事案件適用法律若干問題的解釋》9日公佈,儲存倉並于9月10日起實施。針對司法解釋中的五大焦點問題,最高人民法院新聞發言人孫軍工、中國人民大學刑事法律科學研究中心副主任謝望原、中國青年政治學院副院長林維、中國政法大學刑事司法學院院長曲新久、北京師範大學教授王志祥對此進行瞭解讀。焦點一:對利用信息網絡實施誹謗行為規定入罪“門檻”我國刑法規定,以暴力或者其他方法公然侮辱他人或者捏造事實誹謗他人,情節嚴重的,構成侮辱罪或誹謗罪。此次出台的司法解釋對利用信息網絡誹謗他人構成誹謗罪的兩個要件“捏造事實誹謗他人”“情節嚴重”分別予以了明確。根據解釋,“捏造損害他人名譽的事實”或“將信息網絡上涉及他人的原始信息內容篡改為損害他人名譽的事實”,在信息網絡上散佈,或者組織、指使人員在信息網絡上散佈的,即可認定為“捏造事實誹謗他人”。同時規定:“明知是捏造的損害他人名譽的事實,在信息網絡上散佈,情節惡劣的,以‘捏造事實誹謗他人’論。”解釋規定,具有下列情形之一的,應當認定“情節嚴重”:(一)同一誹謗信息實際被點擊、瀏覽次數達到5000次以上,或者被轉發次數達到500次以上的;(二)造成被害人或者其近親屬精神失常、自殘、自殺等嚴重後果的;(三)二年內曾因誹謗受過行政處罰,又誹謗他人的;(四)其他情節嚴重的情形。長期以來,何謂“情節嚴重”一直是誹謗罪認定中的一大難題。“現在,司法解釋予以了明確。這就意味著凡是利用信息網絡惡意發表誹謗他人信息,達到上述四項標準之一的,行為人必須承擔相應刑事責任。”謝望原說。孫軍工表示,若行為人不明知是他人捏造的虛假事實而在信息網絡上發佈、轉發的,即使對被害人的名譽造成了一定的損害,也不構成誹謗罪。解釋對利用信息網絡實施誹謗行為構成誹謗罪的標準,規定了較為嚴格的“門檻”。焦點二:網絡誹謗“嚴重危害社會秩序和國家利益”可公訴按照刑法規定,誹謗罪除“嚴重危害社會秩序和國家利益的”情形外,屬於“告訴才處理”的案件,即自訴案件。被害人如果沒有自行向人民法院提起訴訟,要求追究行為人的刑事責任的,人民法院不能對實施誹謗的行為人處以刑罰,但“嚴重危害社會秩序和國家利益的”除外。為了準確界定“嚴重危害社會秩序和國家利益”的情形,正確適用公訴程序,解釋列舉了七種情形:(一)引發群體性事件的;(二)引發公共秩序混亂的;(三)引發民族、宗教衝突的;(四)誹謗多人,造成惡劣社會影響的;(五)損害國家形象,嚴重危害國家利益的;(六)造成惡劣國際影響的;(七)其他嚴重危害社會秩序和國家利益的情形。林維說:“考慮到網絡誹謗行為的匿名性、智能性和高度危害性,如果對於誹謗案件的公訴範圍仍然過度限制,勢必使得公民個人舉證不能,因而無法充分保障自身權益,也無法實現社會秩序的良性維持。”焦點三:網上散佈謠言起哄鬧事可追究尋釁滋事罪網絡上,一些不法分子常常利用網絡信息的迅速擴散、不易徹底根除等特性,借助網絡辱罵、恐嚇他人。還有一些不法分子利用信息網絡惡意編造、散佈虛假信息,起哄鬧事,引發社會公共秩序嚴重混亂。根據我國刑法規定,在公共場所起哄鬧事,造成公共場所秩序嚴重混亂的,構成尋釁滋事罪。解釋結合信息網絡的“工具屬性”和“公共屬性”,規定了利用信息網絡實施尋釁滋事犯罪的兩種基本行為方式。一是利用信息網絡辱罵、恐嚇他人,情節惡劣,破壞社會秩序的,依照刑法規定,以尋釁滋事罪定罪處罰。二是編造虛假信息,或者明知是編造的虛假信息,在信息網絡上散佈,或者組織、指使人員在信息網絡上散佈,起哄鬧事,造成公共秩序嚴重混亂的,依照刑法規定,以尋釁滋事罪定罪處罰。曲新久認為,現代社會已經進入信息社會,對“公共場所”概念做符合信息社會變化的解釋是可以接受的,互聯網各類網站、主頁、留言板等網絡空間具有“公共場所”屬性。曲新久指出,盡管在信息網絡公共空間“起哄鬧事”行為,沒有造成網絡上“公共場所秩序”的混亂,但是造成現實社會秩序嚴重混亂危害更大,完全符合刑法規定的“破壞社會秩序的”的要求。焦點四:以發佈、刪除等方式勒索他人可認定為敲詐勒索罪解釋規定,以在信息網絡上發佈、刪除等方式處理網絡信息為由,威脅、要挾他人,索取公私財物,數額較大,或者多次實施上述行為的,依照刑法規定,以敲詐勒索罪定罪處罰。孫軍工表示,不管是“發帖型”還是“刪帖型”,這兩種手段,實質上都是借助信息網絡,主動對被害人實施要挾、威脅行為,進而索取公私財物,完全符合刑法規定的敲詐勒索罪的構成要件迷你倉價錢應以敲詐勒索罪追究刑事責任。此外,他還強調,這條規定使用了“信息”而非“虛假信息”的表述。因此,行為人威脅將要在信息網絡上發佈涉及被害人、被害單位的負面信息即使是真實的,但只要行為人出于非法佔有的目的,以發佈、刪除該負面信息為由勒索公私財物的,仍然構成敲詐勒索罪。焦點五:違反規定有償“刪帖”“發帖”可認定非法經營罪提到“網絡水軍”,大家並不陌生。他們由網絡公關公司僱傭,以獲取利益為目的,在互聯網上集體炒作某個話題或人物,以宣傳、推銷或攻擊某些人或產品。這些受僱人員在“網絡推手”的帶領下,以各種手法和名目在各大互聯網論壇上發帖,為他人發帖回帖造勢。對此,解釋規定:違反國家規定,以營利為目的,通過信息網絡有償提供刪除信息服務,或者明知是虛假信息,通過信息網絡有償提供發佈信息等服務,擾亂市場秩序,具有下列情形之一的,屬於非法經營行為“情節嚴重”,依照刑法規定,以非法經營罪定罪處罰:(一)個人非法經營數額在五萬元以上,或者違法所得數額在二萬元以上的;(二)單位非法經營數額在十五萬元以上,或者違法所得數額在五萬元以上的。王志祥認為,根據該規定,當前比較突出的“網絡水軍”、網絡公關公司的非法經營行為應當予以定罪處罰。依據《互聯網信息服務管理辦法》的規定,國家對經營性互聯網信息服務實行許可制度;對非經營性互聯網信息服務實行備案制度;未取得許可或者未履行備案手續的,不得從事互聯網信息服務。合法的互聯網信息服務市場秩序在我國並非完全處在空白狀態。由此可以看出,“網絡水軍”、網絡公關公司的行為就可能對合法的互聯網信息服務市場秩序造成危害。孫軍工強調,這條規定必須以行為人明知所發佈的信息是虛假信息為前提。“如果行為人不明知所發佈的信息為虛假信息,即使收取了一定的費用,也不應認定為非法經營罪。”新華社記者 陳菲 華春雨 楊維漢(據新華社北京9月9日電)新聞背景國外如何規範網上行為近年來,一些國家或出台相關法律,或採取多重措施,嚴厲打擊網絡謠言這一全球“公害”。在互聯網管理法規的數量上,美國以130多項法規居世界之首。自1978年以來,美國先後出台了《電信法》等130多項涉及互聯網管理的法律法規,包括聯邦立法和各州立法。明確將互聯網世界定性為“與真實世界一樣需要進行管控”的領域,它主要涉及保護國家安全、未成年人、知識產權及計算機安全四個方面,明確規定,不允許利用互聯網宣揚恐怖主義、侵犯知識產權、向未成年人傳播色情,以及從事其他違反美國法律的行為。2005年,新加坡時年17歲的高中生顏懷旭,以“極端種族主義者”自居,在博客上發表數篇攻擊其他族群的言論,甚至叫囂要暗殺部分政治人物。當年11月,顏懷旭被新加坡法院依據《煽動法》判處緩刑監視2年,且必須從事180小時社區服務。新加坡當局毫不諱言《煽動法》適用于互聯網。早在1996年,新加坡就頒佈了《廣播法》和《互聯網操作規則》。2005年10月,韓國政府發佈和修改了《促進信息化基本法》《信息通信基本保護法》等法規,為網絡實名制提供了法律依據。2006年底,韓國國會通過了《促進使用信息通信網絡及信息保護關聯法》,規定韓國各主要網站在網民留言之前,必須對留言者的身份證號碼等信息進行記錄和驗證,否則對網站處以最高3000萬韓元罰款,並對引起的糾紛承擔相應的法律責任。新華社記者 劉奕湛 鄒偉(據新華社北京9月9日電)評論拉起網絡世界的法律“高壓線”最高人民法院、最高人民檢察院9日發佈關於辦理利用信息網絡實施誹謗等刑事案件的司法解釋,將治理網絡謠言等違法犯罪的行動進一步納入法治軌道,同時也為網絡世界拉起了明確的法律“高壓線”。從“謠翻中國”的“秦火火”到借維權斂財的周祿寶,從泄私憤造謠的傅學勝到自建網站敲詐勒索的仲偉……近年來,網絡社會飛速發展,利用網絡實施的誹謗、敲詐勒索等違法犯罪也隨之增加。由於網絡信息傳播速度驚人,一些網絡造謠、傳謠造成的社會危害性甚大,不僅嚴重侵害公民權益、擾亂公共秩序,甚至導致群體性事件。明確劃分網絡言論的法律邊界勢在必行。傳播效果越強,信息發佈責任就越大。最新司法解釋對網絡誹謗等犯罪的行為手段、危害後果進行界定,同時對罪與非罪、此罪與彼罪、輕罪與重罪作出區分,提出明確的量化標準。據此,不僅能為當前認定利用信息網絡實施的誹謗等犯罪提供明確的法律依據,又為公民在網絡世界設置了行為底線。網絡謠言止于法治,止于良好的社會道德環境。但也必須看到,刑罰是“最後的手段”,動用刑罰定要慎重。司法機關應當嚴格按照相關法律法規執行,不枉不縱,不私不盲,以保障公民正當的言論表達。新華社記者 鄒偉 楊維漢(新華社北京9月9日電)迷你倉最平

宏信證券總裁涉嫌受賄被捕
早報記者 忻尚倫—家名不見經傳的小券商,文件倉卻因為總裁涉嫌受賄被捕而在昨日聲名鵲起。宏信證券有限責任公司(以下簡稱“宏信證券”)昨日下午在其官方網站上發佈公告稱,總裁段文清因涉嫌受賄,于8月23日被北京市公安局海澱分局執行逮捕。目前由公司董事長劉曉亞代行總裁職務。公告援引海澱區人民檢察院相關人員的話稱,段文清涉案與宏信證券無關。—北京券商業內人士昨日向早報記者表示,段文清涉嫌的受賄行為可能發生在華林證券任職期間。中國證券業協會網站公示內容顯示,段文清2004年在漢唐證券任職,2007年在華林證券任職,後擔任董事長職務。並于2012年11月8日取得了執業資格證書,于宏信證券任職。據公開資料,段文清畢業于西安電子科技大學,西安電子科技大學深圳校友會網站顯示其為該會常務副會長。段文清較早就進入國信證券工作,歷任國信證券營業部總經理、電子商務部總經理,期間,2001年就有媒體報道其牽頭設立國信證券鑫網,力推網上交易。其後他又先後出任漢唐證券副總裁、華西證券副總裁。段文清在任職漢唐證券和華西證券期間,主導推出了“銀證通”和“機構銀證通”,並快速推動了兩家小券商的業績。而段文清最被業內津津樂道的是,他在存倉林證券任職期間,助推了華林IQ機,後備業內紛紛效仿(編注:華林IQ機是華林證券自主研發的一款移動證券終端產品,集交易和資訊服務為一體o外形酷似一款蘋果手機,3.2英寸的觸摸手寫屏可查看行情和進行交易)。值得—提的是,他還與券業大佬胡關金多有交集,胡關金歷任國信證券總裁、董事長,華西證券總裁,銀河證券總裁。2011年,鬧得沸沸揚揚的華林證券高層集體離職隊伍中,段文清就在其列。在段文清離職後,分管經紀業務的副總裁宋強、總裁孫明霞也紛紛離職。段文清、宋強和孫明霞的從業經歷均包括華西證券、國信證券和華林證券。在沉寂了—段時間後,段文清出現在了當時剛升級為綜合性券商的宏信證券。宏信證券的大股東宏達集團官方網站資料顯示,段文清出席了2012年9月22日至23日舉行的宏達集團2012年第三季度工作總結暨強化執行力建設動員大會。當時段文清的身份為宏信證券董事、顧問。宏信證券前身為和興證券經紀有限責任公司,于2001年8月由四川省6家信托投資機構剝離證券資產合併成立。2012年11月,公司名稱變更為宏信證券有限責任公司,從經紀型券商變成綜合性券商。宏信證券實際控制人為四川宏達集團,宏達集團董事局主席為劉滄龍。迷你倉

一個居心叵測的廣告
9月3日,迷你倉新蒲崗范國威、毛孟靜兩名香港立法會議員連同香港300名「市民」在香港一份免費報紙、一份收費報紙、一份台灣報紙刊登廣告。在報紙上刊登政治廣告,趕時髦,沒有什麼奇怪。假如他們提出香港現在存在的問題、未來發展的建議、提出港台加強經貿合作的主張,兩地政府和議會改善交往的意見等等,都是無可厚非的。但這則廣告卻有些意想不到,居心叵測。內地評論之為「幼稚」;香港報紙稱之為「屎橋」,翻成普通話就是「餿主意」的意思。還有評論認為,這是在香港挑動「統獨」議題,以台港連線對抗北京,在香港挑撥離間、製造敵我矛盾;在台灣媒體的反應也並不見好。 該廣告在香港使用了「換特首是出路,還香港一個家」的標題,這是香港反對派的老套手法,不必浪費筆墨,做過多的評論。但在台灣的廣告卻使用意識形態的、冷戰的強烈語言。廣告的標題是「香港面對嚴重赤化,請台灣引以為鑒」。「赤化」是國共內戰和兩岸處於敵對關係時,國民黨用於醜化共產黨的語言。當時國民黨稱共產黨為「共匪」,實行「共產共妻」,叫共產黨的根據地為「赤化」。這些語言蔣經國先生晚年已經廢棄不用了,很多用過這種語言的人們也早就謝世了。但現在香港竟然還有兩名少壯的立法會議員使用早已過時了的語言,還有三百來人追隨,說明這些人有花崗岩的腦袋,未能與時俱進,恐怕要被淘汰。一般人不想自我淘汰,更不想被淘汰,但這些人卻相反,要借用被淘汰的語言淘汰自己,還要連累不知真相的追隨者。不入流政客圖破壞兩岸三地融合 廣告叫台灣取鑒於港。在台灣長期執政的國民黨有超過百年的政治經歷,曾經在台灣執政的民進黨資歷尚淺,只有不到三十年的歷史,但仍比登廣告的兩名立法會議員的政治閱歷豐厚得多。兩名議員加上其支持者向台灣教路,簡直是班門弄斧,孔夫子面前賣文章。好為人師,必尋其辱。需要從歷史取鑒的倒不是台灣,而是與當今潮流背道而馳的登廣告的人。兩岸中國人的和解和交往是不可阻擋、也不能逆轉的潮流,潮流雖然難免夾帶些泥沙,也自然產生些問題,但關鍵在於是否符合兩岸人民的總體的、共同的願望和利益。對兩岸交往,只有想圍堵中國的少數西方和東方的政客,才會覺得是壞事,想不到香港也有這樣的八、九流甚至是不入流的政客跟在屁股後頭。對內地自由行可能帶來的負面的作用,例如旅遊設施的不足、房地產價格的抬高、交通的擁擠、某些商品的缺貨等,在聰明的商人看來,這根本不是問題,迷你倉出租是商機。只要政府有適當的規劃,加上商人的配合,就是機遇。寶島有大量的旅遊資源,有吸引內地遊客之處,但也不能蜂擁而來,這也只是兩岸旅遊部門的協商和協調問題,豈有因噎廢食的道理。 廣告把「沙士」後內地開放自由行視為負面因素。好了瘡疤忘了疼,是某些人之常情。2002年底、2003年上半年香港發生「非典型肺炎」疫情,加上原來經濟低迷的因素,使香港經濟疲軟,進入蕭條境地,前路迷茫,人心虛怯。如果不是中央當機立斷,改變做法,開放自由行,刺激消費,並以消費帶動經濟的復甦,登廣告的兩名議員及其跟班,現在還能花幾萬塊錢在報紙上說風涼話嗎? 對於「雙非」問題,是香港基本法第24條第2款發生了司法解釋與立法解釋的衝突,本來可以由行政長官根據香港基本法第48條第(2)項的規定,執行全國人大常委會的立法解釋來解決,但當時特區政府沒有這樣做,不能怪中央。對於自由行的人數,本來這是要由兩地的旅遊部門協商解決的問題,但香港特區卻遲遲不建立主管作為支柱產業之一的旅遊業的決策局來統籌、協調有關問題,也不能怪中央。對於旅遊設施、商品供應、房地產價格等類似台灣自由行衍生的問題,本屬商機,可惜香港沒有好好利用,反而繼續緊縮土地供應,使商機成為危機。直到近年才有放寬的苗頭,但為時已晚。作為香港的立法會議員,與其在台灣登廣告,為何不及早督促特區政府有建設性地、積極地作為呢?政客撕裂社會賊喊捉賊 廣告還指責現任行政長官梁振英撕裂社會、其施政未能優先考慮港人利益,要求梁下台。這種指責誇大其詞,嫁禍於人;這種要求荒誕不經,製造事端。梁政府的施政未必事事盡如人意,其班底也未必個個都是賢人聖人。但港人也有目共睹,在梁振英的領導下,特區政府正在因應新的情況,調整治港思路,清理遺留下來的老問題和舊問題,思考「一國兩制」下前瞻性的出路。這都需要時間,為何兩位立法會議員及其朋友們如此心急呢?至於香港新移民的問題,回歸以來有數十萬人之眾,但他們大部分都是香港人的配偶和子女,家庭團聚,既是人權人倫,也是人之常情,有何可指責之處?但連這種基本的倫理,兩名議員及其後輩們還要加以顛倒,自己撕裂社會,還要賊喊捉賊,怪不得連原來聯署的張超雄議員也要公開發表聲明退出聯署。如果張議員前面還可以保留「尊敬的」稱號的話,則范議員和毛議員前面的尊號恐怕要改為「不受尊敬的」,才是名副其實。宋小莊 法學博士迷你倉

本報記者沈麗莉拼客有所減少投訴數量增多隨著出租車起步價的調整,mini storage蘭州市出租車主管部門出台一系列措施,嚴禁出租車強行拼客,同時,對於拒載等不文明行為加大監管和處罰力度。8月22日下午,記者在蘭州市城關區大砂坪嘗試打車。在15分鐘時間里,記者先後向5輛已經載客的出租車招手,以上車輛均未停車載客。一位一起打車的女士表示,以往該路段駛過的出租車基本“滿載”,而乘客大多都是拼車。記者隨後在城關區雁灘大潤發附近繼續調查,過往載客出租車大多未停車。然而,絕非所有出租車都不再拼客。蘭州市民尤女士表示,自己在8月12日從仁�國際乘坐出租車去白雲賓館,沿途駕駛員強行拼客。她當場舉報該出租車的不文明行為,4天後,她接到車行的反饋電話,投訴成立,該駕駛員被停車整頓並罰款500元。尤女士的遭遇不是個例,記者8月23日乘坐出租車時,駕駛員告訴記者,自己依舊在拼客。他說,“現在投訴很厲害,當然不能像以前一樣強行拼客。每次拼客前,我都會很客氣地徵求乘客意見,若得到應允才去拼。”記者在蘭州市城運處稽查大隊瞭解到,調價後首月,消費者對於出租車不文明行為的投訴數量幾乎翻番。稽查大隊大隊長蔣斌告訴記者,投訴數量的劇增主要原因有兩個:第一,投訴電話數量增加到4部,並且24小時開通;第二,通過媒體的廣泛宣傳,更多市民在調價後維護自身權益的意識增強。蘭州市城運處一位不願意透露姓名的人士提醒,市民打車時不要詢問駕駛員是否前往目的地。“只要出租車停車,乘客上車即可。若此時駕駛員拒絕前往,則拒載成立。”他表示,希望在出租車上將來安裝攝錄設備。“無論對於乘客的安全還是投訴處理,都將起到很大幫助。”省人民醫院醫生王平說,通過自己的觀察,出租車不像過去那樣“蠻橫”。但他也表示,以一個月時間來考量出租車行業的新變化還為時尚早,整個行業素質的提高仍需要一個過程。末位淘汰出租車行壓力陡增目前,蘭州市正在進行第四批出租車調價,預計9月20日前後調價工作將全部完成。為規範出租車行業運營,9月初,出租車機打發票設備已全部下發給各出租車公司,全市7152輛出租車的機打發票隨後將全部安裝就位並投入使用,新的機打發票增加了車行名稱、車號、證件號、上下車時間、單價、里程、等候時間、消費金額等信息,同時明確標注了出租車舉報投訴電話(0931-8488798),為乘客尋找失物、舉報維權提供了self storage便。然而,記者與一些出租車駕駛員交談時發現,他們對於調價的態度並不積極。大橋車行一位不願透露姓名的出租車駕駛員告訴記者,調價後不再拼客,但實際收入跟調價前差不多。他的同事說,“調價後對於出租車的監管過於嚴厲,一不小心就會被投訴。”蘭州市城運處相關人士表示,此次調價將優質服務和經濟收入緊密結合,所以很多駕駛員感覺有些嚴厲,但從經濟角度看,他們的收入並未產生太大變化。稽查大隊大隊長蔣斌分析,出租車駕駛員感覺到的嚴厲,更多源於車行施加的壓力。“此番調價後,施行車行末尾淘汰制。因此,車行加大了對出租車司機的管理。車行壓力加大,勢必會督促出租車駕駛員提高服務質量。”緩解運力不足需要各方思考調價後,一個不容忽視的問題是,打車依舊很難。按照省會城市每萬人擁有25-30輛出租車的標準,蘭州市出租車數量仍然不足。然而,蘭州市城運處有關部門負責人則表示,絕不能繼續增加出租車數量。“目前,蘭州市擁有出租車數量為7152輛,但由於限號,實際上路營運車輛約5600輛。打車難不在於車多,而在於車輛的有效運轉。”有人提出,調價之前由於能夠拼客,給人直觀感覺運力得到緩解。蘭州市城運處有關部門負責人表示,調價前,拼客和拒載是出租車行業最讓外界不可接受的兩大問題,出租車拼客有前提,拉少不拉多,如果三人以上,出租車駕駛員一般不會拉,這樣下來,對於運力其實並未起到實質性緩解。有關專家表示,出租車運力不足並非車輛數量問題,實質問題在於城市交通資源不足,道路建設嚴重滯後于交通需求。“目前看來,出租車行業的服務質量,可以通過行政手段能夠實現一定程度的提升,但‘有效運轉’則是一個複雜的工程,如何讓道路交通通暢從而有效解決出租車運力不足,這需要各方面長期思考。”蘭州出租車調價“滿月”之後,雖然尚未達到人們的期望值,但發生的改變有目共睹,蘭州市民王瑾表示,“出租車運力不足我們暫時無法改變,但作為普通消費者,還是期望出租車行業服務態度和質量持續提高。”據瞭解,蘭州市出租車調價後,相關部門還將推出多項政策措施,以推進出租車服務水平的提高。記者關注一個月前,蘭州出租車起步價從7元上調至10元,行業主管部門期望通過此次調價,整治出租車亂象。近日,記者在調查中發現,出租車行業有一些新的變化,但整體服務質量的提高絕非一蹴而就,出租車運力緊缺的現象依然嚴重,各類投訴不降反升。迷你倉

Madison Art Guild: A century of creative connections

But for its members, it was an artistic lifeline."It's an amazing group. When I came to Madison, it was the first thing I joined," said Holl, who has worked in oil painting, pastels and printmaking and exhibited in area art galleries."In town they probably thought of (the art guild) as a group of women who enjoyed painting in their backyard," she said -- but its real purpose, then and now, was to provide artists with a way to connect and grow.Now on the cusp of its 100th birthday, the Madison Art Guild includes both women and men and is an active group -- launching exhibitions and outreach programs, funding scholarships, sponsoring workshops and inspiring countless friendships.Though it was geared toward painters when it was founded in 1914, the guild now includes amateur visual artists from across Dane County working in a range of media, from ceramics and drawing to fiber art, jewelry, stained glass and wood. Members frequently critique and learn from one another's art."One of the things you really appreciate is that art plays a much more central role in a lot of people's lives than we think," said photographer Jake Stockinger, an art guild member for close to 20 years."It's not all museums, it's not all hanging on the wall -- it's doing it," he said."People's lives are enriched by it. A lot of these people went to art school or had some training, or just do it as a hobby. There's everybody, from doctors to engineers to teachers and businesspeople, and they have art in common."The group claims to be one of Wisconsin's oldest guilds -- and is celebrating its centennial with a series of exhibits over the next 18 months. First up: "The Madison Art Guild: Celebrating 100 Years of Community Art," a show featuring 100 works by current Madison Art Guild members, opening Sept. 17 in the Promega art gallery.Like many of its exhibitions, the Promega show is juried, meaning that only pieces selected by an expert judge make it into the show. Likewise, artists interested in joining the Madison Art Guild have to go through a jury application process. Membership is capped at 140, and only about a dozen coveted spots for new members open each year."I've been a scenic artist and a mural painter and faux finisher in addition to painting houses -- that's how I make my living," said Alicia Rheal, who made it into the Madison Art Guild as a new member in Maymini storage"But I'm really new to the art world (and the process of) doing a painting, putting it in a frame and hoping someone will buy it," she said. "I wanted more experience with that and the chance to talk with other artists and learn from these folks."Groups like Madison Art Guild provide essential connections and camaraderie, said Leslee Nelson, who often juries the work of applicants to the guild. Before her recent retirement, Nelson was a longtime UW-Madison professor and director of the Wisconsin Regional Art Program for nonprofessional artists.WRAP, other types of art guilds and groups for nonprofessional artists -- and there are many in the Madison area -- help fill a void that many artists face after leaving college or finishing their formal art training, she said."Our culture is not supportive of artists -- so once you go out in the working world, people think you're crazy for spending the time to make art," Nelson said. "If you don't have someone to talk to about how to make (your art) better, it gets dispiriting. People often stop making art if they don't have that kind of support group."So it's really important, I think, for artists to have other artists to talk to, both somebody who can understand the obsession with making art and understand the need and desire to be improving and stretching yourself," she said.Founded in a two-room studio at Pinckney and Main streets -- where rent was $12.50 a month -- the Madison Art Guild held exhibits and member workshops from the start. The group currently meets monthly at the Fitchburg library, said former president Cindy Koshalek.Koshalek, a jeweler, painter and retired art teacher, credits the guild with giving her important professional contacts."When I've been showing with Madison Art Guild, I've actually been contacted by galleries who said they'd be interested in showing my work," she said. "People see your work and they contact you later and purchase it."Today, close to 40 percent of the membership is male, Kolashek said. Artists with similar interests often form sub-groups to concentrate on, say, photography or watercolor painting.But it's the group's overall diversity that has kept photographer Carolyn Gantner involved in the group since 1994, she said."There's painting, sculpture, multimedia...," she said. Attorney for driver in fatal 2012 crash asks Maine high court to keep her 'texting' admission out of manslaughter trial
Source: Bangor Daily News, MaineSept.迷你倉 09--PORTLAND, Maine -- Once an acknowledged "poster child" for the perils of texting and driving, Kristina Lowe and her attorneys want to make sure no trial judge or jury sees statements she had made previously admitting to doing so.Police have alleged that Lowe was behind the wheel, under the influence of alcohol and texting in the moments before a Jan. 7, 2012, crash that killed passengers Rebecca Mason, 16, of West Paris and Logan Dam, 19, of Norway.But on Monday, Lowe's attorney, James Howaniec, told the Maine Supreme Judicial Court that there's little admissible evidence that his client was either drunk or texting at the time of the crash, an assertion that could undercut prosecutors' case against her.That argument attracted an angry response from the mother of one of the victims. While Howaniec was explaining his position to a group of reporters outside the Cumberland County courthouse Monday in Portland, Deborah Sande, mother of Dam, spoke up on her way out of the building."These kids need to take responsibility for their actions," she said. "Everybody else's life gets to go on, while ours falls apart. She didn't mean to do it, but she needs to take responsibility for her actions."Lowe was in the courtroom for the Monday hearing, but did not speak to reporters immediately after the arguments.Lowe, who was 19 at the time of the crash, faces two counts of Class A manslaughter, two counts of Class B aggravated operating under the influence, two counts of Class C driving to endanger and one count of leaving the scene of a motor vehicle accident resulting in death.The state's highest court heard oral arguments Monday afternoon in prosecutors' appeal of a lower court decision to suppress statements Lowe made to an investigating officer while in the hospital. In those statements, Lowe of West Paris told the officer she was texting at the time of the incident.In December, active retired Justice Robert W. Clifford ruled that the first portion of an approximately half-hour interview with police will be admissible in Lowe's case, that she was lucid and aware despite being on heavy pain medications because of an array of serious injuries including a broken back and nose. However, Clifford ruled that when the investigator left the room and returned with news that the passengers had died -- and that Lowe was facing possible manslaughter charges -- the police officer should文件倉have reiterated that Lowe did not have to answer questions.Howaniec said Monday that Clifford's ruling should be upheld not only because Lowe was not advised of her rights not to answer the questions without an attorney present, but also because incriminating statements she made during the second portion of the interview turned out to be inaccurate."She made statements that were not only against her interests, but she made statements that were incorrectly against her interests," Howaniec told the justices. "She said she was texting, when the forensic evidence showed she wasn't even close to texting at the time."Howaniec said police reviews of cellphone activity from the night in question determined that Lowe did not send any phone calls or text messages at the time of the incident, and the attorney added that although her .04 blood alcohol level was illegal for a minor, it is lower than the .08 threshold to prosecute on drunk driving charges and is too low to be responsible for the crash."For a manslaughter charge, you really need to have egregious behavior," Howaniec said. "Without these statements, we believe the state's case is severely impaired. There's a lot of things she said that were contrary to the evidence."Howaniec has argued that icy road conditions are the primary cause of the crash.Prosecutors differ. Oxford County Assistant District Attorney Richard Beauchesne argued before the court that, because Lowe was lucid and had been informed before the break in the interview that she could stop talking to the investigator at any point, her statements from the second part of the session should be allowed at trial.Beauchesne argued that even though records show that Lowe did not send any text messages at the time of the crash, they do not prove she wasn't reading texts that she had received. Combined with her blood alcohol level, he said, prosecutors have enough evidence for manslaughter charges.
